Terms of Use

Your use of the Fuss website and/or Service constitutes your acceptance of and agreement to all of the terms and conditions in these Terms of Use and the Privacy Policy and your representation that you are 18 years of age or older. Your use of the Service after such posting will constitute your acceptance of and agreement to such changes.


Definitions and Interpretation

The following terms shall have the following meanings in this agreement:

Service domestic services and any other services supplied by Fuss in connection with the supply by the Service Provider

Customer Terms and Conditions the Customer terms and conditions on the Website as may be changed from time to time
Profile the Service Provider's profile on the Website
Website and/or Software downloading, installing or using any associated software and/or platform supplied by Fuss which purpose is to enable you to use the Service
In Writing all forms of visible reproduction in permanent form (including email)

Fuss is Only a Venue

Fuss is a communications platform for enabling the connection between individuals seeking to obtain domestic services and/or individuals seeking to provide domestic services. The Company checks the backgrounds of domestic service providers via all resources available to it, to the best of its ability - either directly or via carefully selected and appropriately regulated third party data verification agencies, identity verification checks to verify the information provided to us. This may include cross-referencing the information provided with, by way of example - passport data, credit bureau or other regulatory authorities etc. However, the Company does not guarantee or warrant, and makes no representations regarding, the reliability, quality or suitability of such domestic service providers. When interacting with domestic service providers you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you don't know. By using the Service, you agree to hold the Company free from the responsibility for any liability or damage that might arise out of the transaction involved.

NEITHER THE COMPANY NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICE. THE COMPANY AND ITS AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE.


Personal Data

The customer acknowledges and agrees that Fuss is entitled to process the Customer’s personal data in accordance with the terms of Fuss’s privacy and cookies policy, which is subject to change from time to time, in accordance with the Singapore Personal Data Protection Act (No. 26 of 2012) (“the Act”). Fuss’s Privacy Policy can be found here.


Release

Fuss expressly disclaims any liability that may arise between Users of its Service. Fuss is only a venue for connecting Users. Because Fuss is not involved in the actual contact between Users or in the completion of the Service, in the event that you have a dispute with one or more Users, you release Fuss (and our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.


Links to Other Web Sites

Links (such as hyperlinks) from Fuss to other sites on the Web do not constitute the endorsement by Fuss of those sites or their content. Such links are provided as an information service, for reference and convenience only. Fuss does not control any such sites, and is not responsible for their content. The existence of links on the Service to such websites (including without limitation external websites that are framed by the Fuss Service as well as any advertisements displayed in connection therewith) does not mean that Fuss endorses any of the material on such websites, or has any association with their operators. It is your responsibility to evaluate the content and usefulness of the information obtained from other sites. The use of any website controlled, owned or operated by third parties is governed by the terms and conditions of use and privacy policies for those websites, and not by Fuss's Customer Terms & Conditions, Service Provider Terms & Conditions or Privacy Policy. You access such third-party websites at your own risk. Fuss expressly disclaims any liability arising in connection with your use and/or viewing of any websites or other material associated with links that may appear on the Service. You hereby agree to hold Fuss harmless from any liability that may result from the use of links that may appear on the Service.


Public Areas

The Service may contain profiles, email systems, blogs, message boards, applications, job postings, chat areas, news groups, forums, communities and/or other message or communication facilities ("Public Areas") that allow Users to communicate with other Users. You may only use such community areas to send and receive messages and material that are relevant and proper to the applicable forum. Without limitation, you may not:

All submissions made to Public Areas will be public, and Fuss will not be responsible for the action of other Users with respect to any information or materials posted in Public Areas.


Account, Password and Security

You are the sole authorized user of your account. You are responsible for maintaining the confidentiality of any password and account number provided by you or Fuss for accessing the Service. Your account is non-transferable. You are solely and fully responsible for all activities that occur under your password or account. Fuss has no control over the use of any User's account and expressly disclaims any liability derived therefrom. Should you suspect that any unauthorized party may be using your password or account or you suspect any other breach of security, you willl contact Fuss immediately.


No Commercial Use or Solicitation

The Service may be used for your personal, non-commercial use only; you may not use the Service in connection with any commercial endeavors whatsoever without the express prior written consent of Fuss. Without limitation, the Service may not be used to solicit for any other business, website or service. You may not solicit, advertise for, or contact in any form Users for employment, contracting, or any other purpose not related to Services facilitated through Fuss without express written permission from Fuss. You may not use the Service to collect usernames and/or email addresses of members by electronic or other means without the express prior written consent of Fuss.


Modifications to the Service

Fuss reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the Service or any content or information on the Service with or without notice. Fuss will not be liable to any party for any modification or discontinuance of the Service.


Confidential Information

We are committed to protecting the information we receive from you. We follow reasonable technical and management practices to help protect the confidentiality, security and integrity of data stored on our system. While no computer system is completely secure, we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved. To increase your security, we do not collect or store your credit card information in any form. For instances where Paypal is used to process payments on the website, PayPal collects credit card numbers on our behalf, with no release of credit card information to Fuss, Paypal’s privacy policies can be viewed at https://www.paypal.com/webapps/mpp/ua/privacy-full.


Indemnification

You hereby agree to indemnify, defend, and hold harmless Fuss, its directors, officers, employees, agents, licensors, attorneys, independent contractors, providers, subsidiaries, and affiliates from and against any and all claim, loss, expense or demand of liability, including attorneys' fees and costs incurred, in connection with your use or inability to use the Service. Fuss reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to your indemnification. You will not, in any event, settle any claim or matter without the written consent of Fuss.

  1. Nothing in this agreement in any way limits or excludes our liability for negligence causing death or personal injury or for fraudulent misrepresentation or for anything which may not legally be excluded or limited.

  2. You must give us a reasonable opportunity to remedy any matter for which we are potentially liable before you incur any costs remedying the matter yourself.

  3. If you are a Customer, we shall not be liable for any loss or damage caused by us, employees, agents and Service Providers in circumstances where:
    • To the extent allowed by law, you and we exclude all terms, whether imposed by statute or by law or otherwise, that are not expressly stated in this agreement. In this clause, any reference to us includes our employees and agents.
    • Our liability of any kind (including our own negligence) with respect to our Website for any one event or series of related events is limited to SGD$100 or the total fees payable by you in the 6 months before the event(s) complained of, whichever is lower.

  4. In no event (including our own negligence) will we be liable for any:
    • economic losses (including, without limit, loss of revenues, profits, contracts, business or anticipated savings);
    • loss of goodwill or reputation;
    • special, indirect or consequential losses; or
    • damage to or loss of data (even if we have been advised of the possibility of such losses).

  5. We are not responsible for indirect losses which happen as a side effect of the main loss or damage, including but not limited: to loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; or, waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise.

  6. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your Booking and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.

  7. This agreement constitutes the entire agreement between us with respect to its subject matter and supersedes any previous communications or agreements between us. We both acknowledge that there have been no misrepresentations and that neither of us has relied on any pre-contractual statements.

Transactions

Fuss will not be a party to any contracts for Services. Fuss facilitates these contracts by supplying a medium for the exchange of money. Fuss customers pay using credit card through our payment processing gateway for each requested service.

24 hours after a service completed, if there is no complaint by the Customer, the service will be marked as closed by Fuss. Then the agreed payment will be transferred to the Service Professional's bank account via online transfer, 2 days after the service is completed. The Service Payment must be paid through the Fuss Web Service. Any Service Payments paid in cash outside of the Fuss Web Service are NOT subject to refunds. Any reimbursement expenses that are incurred by a Service Provider in connection with the connection of a Service may, however, be paid in cash offline.


Billing and Payment Policy - Payment for Services / Cancellation by You

  1. Customers are obligated to pay for the services of the Service, unless specifically notified otherwise. For all purchases and payments for reimbursement costs, fees or expenses associated with a Service, Fuss will charge your credit card according to the amount agreed upon between you and Fuss for the use of the services of the Service, and you hereby authorize us to charge your credit card for such amounts. Fuss retains the right, in its sole discretion, to place a hold on any payment for a completed Service transaction.

  2. No refunds or credits will be provided once the Fuss Customer's credit card has been charged. At Fuss's sole discretion, refunds or credits may be granted in extenuating circumstances, as a result of specific refund guarantee promotions, or to correct any errors made by Fuss.

  3. While Fuss will use commercially reasonable efforts to ensure the security of all credit cards and all other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties, and you agree to hold Fuss harmless for any damages that may result therefrom. Fuss exclusively uses Stripe to process credit card information. For further information regarding that service, please contact Fuss to request information about Fuss's credit card processing providers.

  4. You will be liable for all transaction taxes on the services provided under this Agreement (other than taxes based on Fuss's income).

  5. You must make payment in full upon completion of service provided for all bookings.

  6. You can at any time, up to 3 hours before the start of your booking, cancel any individual visit in our system. There is no charge if your booking has not been confirmed before the scheduled start time for the Service Provider visit. If so, your credit card will not be charged. If you cancel after the booking has been confirmed and with less than 24 hours to the booking, then we will charge an administrative fee of 1 hr of either $22 or $25 as stated on our Website by charging your credit / debit card / Stripe™ account and you authorize us to do so accordingly. For a one-time booking, should you wish to reschedule, please use the 'Edit Booking' functionality on your dashboard to make the required changes. This is available as long as no cleaner is assigned to the booking, or if there is a cleaner assigned, then this function is only available up to 48 hours prior to the start of the booking. Alternatively, you may contact us at support@fuss.sg. Charges may apply. Please see our FAQ for more information.

  7. We may at any time change the prices. We will give you notice by email at least one month before any price change takes effect. If you do not accept the new fee, you should cancel this agreement as explained below. Otherwise the Services supplied after the expiry of the one month’s notice will be at the new price.

  8. If there is a no-show and you notify us via our Website within 24 hours after the scheduled start time, then we will, at your option use reasonable endeavours to re-arrange the visit. Whether you do or do not wish for the service to be rescheduled, your card will not be charged, only and unless service has been rendered thereafter. We reserve the right not to make a refund or re-arrange a visit if we are not notified within that 24 hour period once your card is charged.

  9. If any amount due by you is unpaid, we may:
    • charge reasonable additional administration costs; and/or
    • charge interest on the amount unpaid at the rate of 2% p.a. over the SGD Deposit rate at the time being of Development Bank of Singapore Ltd (DBS Bank (Singapore)).
    • arrange of the supply of Services to be suspended; and/or
    • cancel this agreement with or without written notice (including email).

Recurring Billing and Payment Policy - Payment for Services / Cancellation by You

  1. You must provide your credit card number in advance for the first Service Provider visit in the case of Repeat Bookings (referred to below as “the Deposit”). You will be charged only after the service is rendered. For subsequent recurring visits, your credit card will be debited anytime within 24 hours (1 day) after the service is rendered. Fuss bills and debits booking payments on a weekly basis. If a recurring booking is cancelled / stopped via the website or through informing Fuss, the entire series of recurring bookings are considered cancelled and the Service Provider shall not render the service on the scheduled dates and thereafter.

  2. Recurring billings can only be made if you provide a valid credit card number.

  3. You can at any time, up to 3 hours before the scheduled start time, cancel a Recurring Booking via our Website or by contacting us at support@fuss.sg. There is no charge as long as your booking has not been confirmed and is not less than 24 hours to the scheduled start time for the Service Provider's visit. If you cancel after the booking has been confirmed and is less than 24 hours to the scheduled start time for the Service Provider's visit, then we will charge an administrative fee of 1 hr of either $22 or $25 as stated on our Website either by deduction from the Deposit (if applicable) or by charging your credit / debit card / PayPal account and you authorize us to do so accordingly.

  4. CCancellation for appointment is as per above. For cancellation for billing, it follows the service dates and recurrence that has been selected by you. As long as no service is rendered, your credit card will not be charged. If you have cancelled via our website or via email, and the recurring billing has occurred, kindly inform us at hksupport@fuss.asia and we will refund you the charges accordingly.

  5. For a recurring booking, should you wish to change your booking timing on a one-off or going forward basis, please use the 'Manage Booking' functionality on your dashboard to make the required changes. Alternatively, you may contact Fuss at support@fuss.sg. Charges may apply. Please see our FAQ for more information.

  6. We may at any time change the prices. We will give you notice by email at least one month before any price change takes effect. If you do not accept the new fee, you should cancel this agreement as explained below. Otherwise the Services supplied after the expiry of the one month’s notice will be at the new price.

  7. If there is a no-show and you notify us via our Website within 24 hours after the scheduled start time, then we will at your option use reasonable endeavours to re-arrange the visit. Whether you do or do not wish for the service to be rescheduled, your card will not be charged, only and unless service has been rendered thereafter. We reserve the right not to make a refund or re-arrange a visit if we are not notified within that 24 hour period once your card is charged.

  8. If any amount due by you is unpaid, we may:
    • charge reasonable additional administration costs; and/or
    • charge interest on the amount unpaid at the rate of 2% p.a. over the SGD Deposit rate at the time being of Development Bank of Singapore Ltd (DBS Bank (Singapore)).
    • arrange of the supply of Services to be suspended; and/or
    • cancel this agreement with or without written notice (including email).

Cancellation by us

  1. We may at any time without cause cancel any particular Booking or this agreement as a whole including your right to use our Website, giving notice by email to the extent reasonably practicable. If so, we will refund in full your Deposit / Booking Payment in the case of Repeat Bookings where the first visit has not yet occurred.

  2. Following cancellation of this agreement: Accrued rights and liabilities are unaffected. All clauses in this agreement which are stated or intended to continue after cancellation will continue to apply. You must not attempt to re-register for or continue to use our Website if we have given you notice of cancellation.

Act of God

Neither you nor we are liable for failure to perform or delay in performing any obligation (excluding payment) under this agreement if the failure or delay is caused by any circumstances beyond your or our reasonable control including third party telecommunication failures.


Termination and Suspension

Without limitation, Fuss may terminate or suspend your right to use the Service if you breach any term of this Agreement or any policy of Fuss posted on the Service from time to time, or if Fuss otherwise finds that you have engaged in inappropriate and/or offensive behavior.


Refund Policy / Damage or Theft Refund Guarantee

Since domestic service is a very personalized and subjective service, we cannot offer refunds to our clients. However, we want you to be 100% satisfied with Fuss. If you are not completely satisfied with your domestic service, simply contact us within 24 hours of your service and we will schedule a time convenient to both you and either the same or another service provider to return to re-service the specific areas that you are dissatisfied with.

Fuss's Damage or Theft Refund Guarantee is our promise to you that if in the event of theft or damage to your property, we will either not charge / refund you your service fee upon complete verification of the theft or damage. You must inform Fuss within 24 hours of the occurrence. The refund timeframe will be anytime between 7 to 14 working days upon complete verification.


Dispute Resolution

To expedite resolution of any dispute, controversy or claim related to this Agreement ("Dispute"), you and Fuss agree to first attempt to negotiate any Dispute (except those Disputes expressly excluded below) informally for at least 30 days before initiating any arbitration or court proceeding. Such informal negotiations will commence upon written notice. Your address for such notices is your billing address, with an email copy to the email address you have provided to Fuss.


Special Promotions

Fuss may from time to time provide certain promotional opportunities to Customers. All promotions will be run at the sole discretion of Fuss, and can be activated, modified or removed at anytime by Fuss without advance notification.

In the event that you are given a code by or on behalf of Fuss through which you may refer a friend to Fuss in exchange for a referral credit, you shall not use any online marketing or advertising to promote such code or to artificially increase the amount of credits awarded. By way of example, you may not post, or cause, request or permit a third party to post any such code on a coupon website, nor use any paid search marketing, online advertising, forum posting, newsgroup posting or bulk email to disseminate such code. You may only share such code with your personal friends and acquaintances for legitimate referral purposes, as determined by FUSS in its sole discretion. Without limiting Fuss's other rights and remedies, Fuss may terminate such code and/or your account for any breach of this Section.


No Agency

No independent contractor, agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by this Agreement.


Intellectual property rights

  1. All trademarks, logos, graphics, images, photographs, animation, videos, text and software used on the Website are our intellectual property or that of our partners. For the purposes of your personal use only, you may view such material on your screen and print a single copy. You may not otherwise use, sublicense, retrieve, display, modify, copy, print, sell, distribute, download, hire, reverse engineer (unless permitted by applicable law) or create extracts of, or derivative works from, such material without our specific prior written consent.

  2. For the avoidance of doubt you may not collect, scrape or harvest any Content on our Website or deep-link to or frame Content on our Website without our specific prior written consent.

  3. You must not circumvent or otherwise interfere with any security related features of the Website or features that limit or prevent copying of Content or which restrict use of Content.

  4. If you publish any Content on our Website, you grant us a worldwide, perpetual, non-exclusive, royalty-free licence to copy, alter, adapt or display such Content on our Website. You also grant each User a license to use your Content to the extent permitted by the functionality of the Website and these terms and conditions.

General Provisions

Failure by Fuss to enforce any provision(s) of this User Agreement will not be construed as a waiver of any provision or right. This Agreement constitutes the entire agreement between you and Fuss with respect to its subject matter. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will be enforced to the fullest extent possible, and the remaining provisions will remain in full force and effect. This Agreement will inure to the benefit of Fuss, its successors and assigns.


Changes to this Agreement and the Service

Fuss reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement (including the Privacy Policy) at any time, effective with or without prior notice. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must terminate, and immediately stop using, the Service. Your continued use of the Service following any revision to this Agreement constitutes your complete and irrevocable acceptance of any and all such changes. Fuss may change, modify, suspend, or discontinue any aspect of the Service at any time. Fuss may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
